We work with a network of consultants to evaluate new technologies. Our goal is to improve our service by providing a quick and secure delivery of information and documents. The progress information for our clients’ cases is available real-time and on-line via our web-interface called MGWeb.

We already have a process in place to retrieve business records for our complex litigation, why would I need The Marker Group’s Records Collection & Analysis service?
A.
Complex cases generate the need to obtain large numbers of medical and business records on multiple plaintiffs. This results in an avalanche of information. Simply retrieving documents does not produce information essential to structure an effective defense. The Marker Group’s Records Collection & Analysis service is focused on your particular litigation objective and produces a highly efficient, structured system of information. This is accomplished through a process utilizing predetermined search criteria. Data is extracted, coded, and organized so that specific information, trends, and links between records and among cases can be identified and accessed.

Q.
Why can’t my firm implement a Records Collection & Analysis process using in-house resources?
A.
The Marker Group's process is based on extensive experience with national multi-claimant lawsuits. Our efficiency in providing this service is attributable to both our staff experience and our proprietary software systems. Our records collection and analysis clients have found that their in-house resources are more efficiently utilized in evaluating the information we provide to prepare an effective defense.

Q.
What information do you need to begin searching for records?
A.
We can begin searching for records with answers to interrogatories or the last known place of residence. We will work within your parameters on type, age, or any other restriction on the records, so that we only obtain records relevant to the litigation.

Q.
Do you serve subpoenas locally and/or out-of-state?
A.
Yes. We are qualified to serve subpoenas within Texas to obtain records and provide this service for many clients. We have obtained records from all 50 states and internationally. We have done this by researching state rules of civil procedure and working with the client law firm to determine appropriate legal procedures. When necessary, we have contracted and supervised a local agency.

RECORD RETRIEVAL

Q.
How long will it take for me to receive records?
A.
If your order is time sensitive, simply notify us in advance and we will fax the authorization or subpoena to the records custodian, mail the original, and follow up with immediate phone calls. Turn around time is dependent on the notice period of the state in which the lawsuit is filed. If the opposing counsel does not respond with the Waiver of Notice in a timely manner, we will contact them by phone.

Q.
How will you notify me of the progress of my order?
A.
All status information is made available via our secure, web-based interface MGWeb. MGWeb is available for access twenty-four hours a day, seven days a week.

Q.
Must I pay custodian fees in advance?
A.
No. The Marker Group will pay all custodian fees for you up to an amount approved by you in advance. These fees will be included on your invoice.

MEDICAL REVIEW

Q.
Our firm has paralegals and legal assistants. Why do we need registered nurses to perform our reviews?
A.
The Marker Group’s registered nurses not only summarize the records, but can analyze the presenting conditions, treatment received, and prior medical, surgical and family history. Our nurses interpret the damages as well as any potential alternate causation for the alleged injuries. The nurses’ clinical training and experience make this more efficient than the efforts of a person with no medical training.

Q.
We already employ nurses in-house. Why do we need to use The Marker Group’s nurses?
A.
The Marker Group’s network of nurses and medical transcriptionists can complement in-house capabilities to handle excessive workload in a timely and cost-efficient manner. Often, in-house nurses are functioning at maximum capacity with their current caseload and are unable to handle the review, analysis and summarization of the voluminous medical records involved in a complex toxic tort, environmental exposure, or product liability case. Additionally, there may be times just prior to trial, deposition or other deadline when records are produced and need to be summarized quickly.

Q.
Besides reviewing medical records, what other services do your nurses offer?
A.
Our nurses perform case-specific medical research, much of which can be accomplished from our office, with copies of authoritative treatises and textbook excerpts obtained online. We review records for a number of different purposes, including analysis of liability and causation issues, assessment of damages, witness identification, and mitigation of damages based on alternate causation. The resulting reports are prepared in a variety of formats, with or without the nurse’s editorial comments. Report formats include the chronology of treatment, annotated chronology, and narrative summary. In some cases, we are asked to prepare a subject matter index. Our reports are customized to the attorney’s specification.

Can you transcribe tapes and dictation involving medical terminology?
A.
Yes. We utilize support personnel who have legal and medical transcription experience and can complete the transcription accurately and efficiently.
